The Barcelona Court has annulled the extensions of the investigation, causing the procedure, initiated in 2021, to remain without the main suspects having provided statements.
A criminal pattern against the most vulnerable
The victims, mostly elderly and individuals with psychological issues, approached the notary believing they were signing personal loans for immediate liquidity. However, according to police records, what they were actually signing was a purchase option on their own home for a ridiculous price. Additionally, they granted an "irrevocable" power of attorney that allowed the lender to sell the property unilaterally and without prior notice.
Investigations suggest that behind the scheme is a "network of people" and companies that, with the notary's collusion, acted together to deceive the victims. The Barcelona Prosecutor's Office and private accusations have repeatedly denounced the paralysis of the case, which has bounced from court to court over the past five years.
A judicial labyrinth of five years
The case began in 2021 in the 32nd Investigating Court of Barcelona, where complaints accumulated due to the identical pattern of the frauds. By the end of 2025, the prosecutor managed to transfer the case to the 3rd Investigating Court of Barcelona, which had already investigated the scheme in 2018. However, the recent decision by the Barcelona Court to annul the extensions has once again frozen the process.
The victims, who have been waiting for answers for five years, have expressed their outrage at what they consider an injustice. "It is frustrating to see how the judicial system does not protect the most vulnerable," stated one affected individual, who preferred to remain anonymous. "We lost our home and on top of that, justice is not progressing."
What happens now with the investigation?
With the annulment of the extensions, the case is left in a kind of judicial limbo until the appeals are resolved. The Barcelona Prosecutor's Office has already announced it will appeal the decision, while the private accusations are considering submitting a document to reactivate the investigation. In the meantime, notary Sergi G.D. remains on provisional release awaiting a new date for his statement.
